Abstract/Contents: | "This paper has ben prepared to emphasize the role of roadside management in helping to control the rapidly expanding problem of tort liability. Highway agencies are being overwhelmed by this issue. In 1987, over 27,000 tort claims and suits were filed against state highway agencies, and the number of suits has been growing at the rate of 19% per year since 1972. Currently there are at least $15 billion in pending suits, with the 1987 financial loss to highway agencies at all levels of government conservatively placed at $400 million. Almost all of these suits allege negligence in constructing, operating or maintaining a roadway. To defend themselves, the highway agencies try to demonstrate that their actions were reasonable (e.g., not negligent). This paper gives practical advice on minimizing liability by routinely reporting situations that might cause serious traffic accidents. Typical high-risk areas are discussed in the paper to assist roadway employees in identifying these sites and situations. Minimizing risk for the motorist becomes a key to minimizing the agency's risk in court." |
