| Abstract/Contents: | "In the past 40 years there has been tremendous progress in the development of improved turfgrass cultivars of major turf species. The amended U.S. Plant Variety Protection Act (PVPA) that went into effect in 1995 has a provision called essential derivation. The objective of this provision is to encourage plant breeders to collect new sources of germplasm by exploration rather than merely selecting new cultivars out of existing commercial cultivars. The patents that protect new innovations for use in plant transformation greatly complicates the development process for new commercial turfgrass cultivars. Permission for freedom to operate for research activities can be easy to get but these patented genes or technologies severely restrict or prohibit the release of commercial cultivars. The implications of the patent laws and new PVPA regulations will be discussed as well as research on fingerprinting of turfgrass cultivars." |
