Abstract/Contents: | Profiles a ryegrass variety called `Marshall,' which "lost its U.S. Plant Variety Protection (PVP) due to an expired PVP certificate [in 2002]...however, in 2004, an amendment directing the Secretary of Agriculture to extend the variety's term of protection under the PVP Act was included in an omnibus apporpriations bill. A new certificate was issued for 10 years, with the possibility of termination after five years." Explains the negative way this effects intellectual property rights (IPR). Presents concerns about the future of `Marshall' annual ryegrass. Explains that "ASTA will file an amicus curiae (friend of the court) brief in favor of upholding the PVP Act if the `Marshall' ryegrass case goes to court." |
